All suspects are presumed innocent until determined guilty in court.

Garland County Sheriff’s Patrol Deputy Wagner reports the following:

On 08/15/19 at approximately 1721 hours, I responded to the 500 block of Charming Heights Road in reference to a possible accident.

Upon my arrival, GCSO Corporal Clayton Green and Deputy Elwood McConnell were already on scene.  Cpl. Green advised that the driver of the white Ford F150 was possibly intoxicated.  I then went over and spoke to the driver, who was identified as David Forest Norton.

David Forest Norton, 46, of Arkansas Avenue in Rose Bud, AR – Allegedly blew almost double the legal limit after only having “one drink”.

Norton advised that the truck on scene was his and that he only had one “drink” prior to driving.  Norton had the odor of intoxicants emitting from his breath and person, red bloodshot watery eyes, slurred speech, and appeared to be unsteady on his feet.

I asked Norton if he would be willing to take the Standardized Field Sobriety Test and he advised that he would.

During the horizontal gaze nystagmus test, Norton displayed a lack of smooth pursuit in both eyes, displayed distinct and sustained nystagmus at maximum deviation in both eyes, and displayed the onset of nystagmus prior to 45 degrees in both eyes, totaling 6 clues.

During the walk and turn test, Norton started too soon, stepped off line, and missed heel-to-toe, totaling 3 clues.

During the one leg stand test, Norton used his arms to balance, totaling 1 clue.

Norton was then placed into custody and charged with Driving While Intoxicated and was transported to the Garland County Detention Center for processing.

While at the Detention Center, Norton consented to a breath test and blew a .15% on the EC/IR-II Intoxilyzer machine.

Mr. Norton’s charge carries a bond amount of $1,000.
