All suspects are presumed innocent until determined guilty in court.
Hot Springs Police Officer 1st Class Wes Smith reports the following:
On 08/20/2019, a victim reported a burglary to his residence. In the burglary the suspect/s took his Regions Bank check card.
On 08/20/2019 at approximately 1908 hours I, Officer Wes Smith, responded to a hotel in the 4300 block of Central Avenue in reference to a disorderly subject.
I made contact with the manager and the suspect, Darlene Ann Kostyk, at the front desk.
The manager stated that Kostyk had a credit card belonging to the victim on file that was preapproved but when she attempted to charge this card for the balance of $529.03, the card was declined. The manager stated that she also attempted to contact the owner of the card multiple times for authorization but was unable to do so.
Kostyk provided a Regions credit card that also belonged to the victim but the manager refused due to the hotel’s policy.
Kostyk was given multiple opportunities to get a way of paying but was unable to do so. I arrested Kostyk for theft of services.
During a search incident to arrest, I located a Regions Bank Check Card belonging to the victim in Kostyk’s right hand.
The victim was contacted and he was asked if Darlene Ann Kostyk had permission to have his debit card information. The victim said Kostyk did not have permission to be in possession of his card and this was the card taken during the burglary of his residence.
Officers also located a Jeep key/fob in Kostyk’s left rear jean pocket. Sergeant Freeman took the key/fob to a local wrecker service and was able to confirm that this key/fob belonged to a 2018 Jeep Renegade that had been reported stolen through the Little Rock Police Department on 08/05/19 and was recovered by the Hot Springs Police Department at approximately 1300 hours today from the parking lot of the hotel. The estimated value of the key/fob is one hundred dollars.
Ms. Kostyk was transported to the Garland County Detention Center. She is charged with Felony Theft By Receiving, Theft Of Services, and Theft By Receiving, with a bond amount totaling $4,500.
